Basically, bail is an insurance policy guaranteeing that a person being released from custody while awaiting trial will show up for all court appearances until the case is decided. Bail bondsmen use an insurance company whose agents post a bond as security. This guarantees a defendant’s appearance in court.

When a person is arrested and booked into custody, a background check is performed. This is done to make sure the person doesn’t have outstanding warrants or is wanted elsewhere. If the person clears the background check, the court sets a bail amount depending on the severity of the crime. Other factors considered (job history, length of time at residence, family life, etc.) come into play as well. Once the defendant secure bail, he or she can get out of jail while they wait for their trial.
