Can a Bail Bondsman Detain You for Failing to Pay Fees?

No, no and NO! We as a company offering Wilmington bail services stand by the fact that a bail bondsman has no authority to hold you against your will, much less through coercion, simply for not being able to pay bail-related fees.

We say this because of an ongoing case in Modesto, California, where a judge ruled there is sufficient evidence for the owner of a bail bonds business to stand trial for extortion and holding clients against their will. Aleo John Pontillo, the owner of AJ’s Bail Bonds, is accused of conspiracy to commit grand theft, conspiracy to kidnap for the purpose of extortion and violating state insurance regulations.

One plaintiff claims that he was handcuffed to a weighted bench until his father came and paid the bail money. Another plaintiff claimed employees held a woman at the business and threatened her with jail if she did not pay up. They even ‘showed’ her a stun gun in a poorly hidden attempt at coercion. Pontillo and two other co-defendants are also accused of conspiring to steal in excess of $250,000 from the local county by submitting false and fraudulent bond claims.

Cases like these cast a bad light upon those in our business who are legitimately helping those in need of bail bonds. We nonetheless need to learn from them if we are to win the trust of our clients. After all, no bail bond company will survive long when it has been accused of kidnapping and extorting its own clients!

Traffic Arrests – How Bail Bondsmen Can Help

How-Bail-Bondsmen-Can-HelpIt’s never comfortable being pulled over by the police while driving. And most traffic violations end reasonably well. A person is issued a citation and has to pay a fine. Some though, carry harsher consequences. Potentially, any of the following could land you in jail: reckless driving, DUI (driving under the influence) or DWI (driving while intoxicated), driving without insurance, driving with an expired or suspended license.

Maybe you never plan to be in any of these situations, and maybe you won’t. But if you do find yourself in such a predicament, or if a family member or friend is arrested on a traffic violation, you may be entitled to bail bond services. Depending on the severity of your offence, your bail may not be too expensive. If it is serious, your bail could be thousands of dollars. Oxford Bail Bonds charges a 15% fee on any bail amount. For instance, if your bail is set for $2000.00, your fee would be $300.00.
